Terms and Conditions for the St. Nicholas Raffle

Terms of Participation

In the following, personal designations apply equally to persons of male and female gender.

By participating in the prize draw, you accept the following terms of participation:

  1. The organiser of the prize draw is Sterntaler GmbH, Werkstrasse 6-8, 65599 Dornburg-Dorndorf, Phone: +49 (0) 6436-509-0, service@sterntaler.com.
  2. The prize draw begins on 05.12.2025 and ends on 20.12.2025.
  3. The prize to be drawn is as follows: A family holiday for 2 adults and their children for 4 days/3 nights including half board and suitable additional services such as wellness, sled rental, etc.
  4. Eligible to participate are natural persons who are of full age (i.e. at least 18 years old) and fully capable of conducting business at the time of participation ("participants") and whose place of residence is in Germany, Austria or Switzerland. Employees of Sterntaler GmbH and other persons involved in the implementation of the prize draw as well as their relatives are excluded from participation. Persons who use unauthorized aids or otherwise gain advantages through manipulation (e.g. also through the use of prize draw machines) are also excluded. In such cases, prizes may be revoked and/or reclaimed afterwards.
  5. The participation requirement is to follow the Sterntaler social media channel on which the prize draw takes place (Facebook or Instagram), as well as that of the cooperation partner Dilly – The National Park Resort in Upper Austria, and to link the channels (Facebook or Instagram), to like the prize draw post and to place a comment according to the prompt under the post.
  6. Each participant may only take part in the prize draw once. Irregular or repeated participation by a participant will result in exclusion from the draw.
  7. Participation in the prize draw is free of charge and independent of the purchase of goods or services. Participants only have to bear the costs associated with participation via the internet themselves (usage fee for internet connection).
  8. The winner will be determined by random selection and only among those participants who have complied with the terms of participation. In the case of multiple entries, the draw decides.
  9. The winner will be contacted promptly by the official company account @sterntalergmbh and asked to verify their contact details. The transfer of the winner’s data to Dilly - National Park Resort (Pyhrnstraße 144580 I Windischgarsten I Austria) is necessary for sending the voucher and further arrangements as well as booking.
  10. Cash payment of the prize or exchange of the prize is not possible. The prize is non-transferable. The claim to the prize expires if the prize cannot be delivered within four (4) weeks after dispatch for reasons attributable to the winner.
  11. Sterntaler GmbH reserves the right to suspend or terminate the prize draw wholly or partly at any time if this is necessary for reasonable reasons, especially due to technical or legal reasons. Sterntaler GmbH will make use of this option in particular if a proper execution of the prize draw cannot be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation or errors in hardware and/or software) or legal reasons. Participants have no claims against Sterntaler GmbH as a result. If such a disruption of the prize draw is caused culpably by the behaviour of a participant, Sterntaler GmbH may claim compensation for the damage caused.
  12. The liability of Sterntaler GmbH, its bodies, employees and vicarious agents arising from or in connection with the prize draw, regardless of the legal grounds, is limited to intent or gross negligence, except for personal injury, expressly declared guarantees or damages within the scope of the Product Liability Act. The above limitation of liability also applies in particular to damages caused by errors, delays or interruptions in transmission, technical system and service disruptions, incorrect content, loss or deletion of data or viruses. Sterntaler GmbH is not liable for material and/or legal defects in the awarded prizes.
  13. The law of the Federal Republic of Germany applies. Furthermore, mandatory provisions, especially of the law of the state in which the participant has their habitual residence, remain unaffected, provided the participant is a consumer. Legal recourse is excluded with regard to the drawing of winners and any assessment of the content of the submitted prize draw entries.
  14. Should individual provisions of the terms of participation be or become invalid, the validity of the remaining terms of participation shall remain unaffected. They shall be replaced by the valid provision which most closely corresponds to the purpose of the invalid provision.

Privacy Notice:

The processing of data in connection with participation in the campaign is carried out by Sterntaler GmbH. You can reach the data protection officer of Sterntaler GmbH at datenschutz@sterntaler.com. The processing of data is based on your consent according to Art. 6 para. 1 lit. a GDPR and according to Art. 6 para. 1 lit. b GDPR, as the data processing is necessary for the execution of the campaign. After completion of the campaign, all stored data will be deleted. Your personal data that you provide to us within the framework of the campaign (first and last name, email address, postal code, place of residence, further personal data) will only be collected, processed and used for the purpose of carrying out the campaign. The execution and handling is carried out by Sterntaler GmbH, which collects, stores and uses the data necessary for the execution of the campaign in compliance with data protection regulations. The personal data of the winner will also be transmitted to the hotel Dilly - National Park Resort for the purpose of prize processing. You have the right at any time to obtain information about your stored data. Furthermore, you have the right, if the legal requirements are met, to correction, blocking or deletion of your data and to the transferability of provided data. You can revoke your consent to the storage and use of the collected data at any time with effect for the future at info@sterntaler.com. Please contact our data protection officer directly regarding the assertion of your rights. You may also lodge a complaint with a supervisory authority at any time.
